TERMS AND CONDITIONS

 The purpose of the subject matter of these Terms and Conditions is to define the rights and obligations of the parties in the context of distance selling of products offered by the Company. The customer acknowledges that they have read and agree to these Terms and Conditions when placing an order. Any confirmation of one’s order constitutes acceptance of the Terms and Conditions without exception.

The Company reserves the right to revise or amend the Terms and Conditions at any time. In the case of a change, the Terms and Conditions in effect at the time of the order registration will be applied.

Shipper:

Person providing delivery service to the customer.

Article 1. Order registration

The sequence of steps for online order registration:

1.1. Selection of Product(s).

The products presented on the website have a name, description, additional information (formulation, dosage, etc.), selling price (including VAT) and picture(s). Pictures posted on the website may differ from the actual appearance of the product.

After visiting the website and selecting the products, the customer adds them to the website’s basket and proceeds to the next step of order registration.

IMPORTANT NOTE: Drugs intended for the treatment of oncological diseases, psychotropic and specially controlled drugs are not subject to sale or delivery through the Company's online pharmacy.

          1.1.1. The selling price of the product shall be the price displayed on the website at the time of the customer's purchase.

                   The sales price includes VAT, but does not include the delivery price, which is calculated additionally.

1.1.2. Total order amount:

                   The total amount of the order is its final price in Armenian drams, including shipping costs.

1.2. Data entry and delivery selection

The information entered, as well as the delivery methods, possible schedule and costs are posted on the website. The customer ensures that all the information he has entered is correct (contact details, shipping address, etc.) and selects the preferred shipping method according to the schedule and amount.

1.3. Order confirmation

The customer checks the details of his order, corrects errors as necessary.

The customer, having read and agreed to these Terms and Conditions, confirms his order and enters the payment page.

1.4 Payment

Payment for the order can be made online using a bank card or Idram payment system, or in cash by paying the courier at the time of delivery.

The cash payment option is available only in Yerevan.

1.4 Order Confirmation

After making the payment, the customer receives a confirmation e-mail of his order. That e-mail is the customer's proof of online purchase, which the company advises to keep.

The confirmation letter records the registration of the order and contains the following elements:

- order number

– information about the product(s) purchased

– the total amount of the order

– delivery address

Article 2. Method of payment

4.1. In case of online payment, the following bank cards are accepted: VISA / MASTERCARD / ARCA / and Idram electronic payment system.

4.2: The customer has the opportunity to choose the cash payment option, in which case he is obliged to make a payment to the courier of the company or an intermediary organization (only in the case of deliveries made in the city of Yerevan).

Payment is made exclusively in AMD.

4.3: Payment transaction

The Customer warrants to the company that it has all necessary authority to use the selected payment method. If the use of the card is rejected by the payment center, the order is automatically cancelled.

Article 3. Delivery

The ordered items are delivered to the customer according to the following conditions:

AAF Group LLC company provides delivery service throughout the territory of RA.

Delivery is carried out according to the price list and schedule mentioned in Annex 1.

*Important observation, throughout the territory of the RA, except for the city of Yerevan, orders are carried out after online payment.

**After informing about the arrival of the order, the courier can wait for the customer for a maximum of 10 minutes.

Article 4. Responsibility

The owning company of the website, undertakes to follow the legislative or regulatory provisions in force in Armenia.

The Company is not responsible for the customer's lack of familiarity with the General Terms and Conditions of Sale and the problems arising from it.

The Company is not responsible for technical issues of the website.

The Company shall not be liable in the event of force majeure as defined in Article 5 of the Terms and Conditions.

The company is not responsible for problems caused by Internet disruptions / service interruption, presence of computer viruses, etc.

Article 5. Force majeure

The parties are released from liability for failure to fully or partially fulfill the obligations under these terms and conditions, if this was due to the influence of force majeure, which arose after assuming the obligations under these terms and which the parties could not foresee or prevent.

Such situations are earthquake, flood, war, declaration of military and state of emergency, political disturbances, strikes, suspension of work of means of communication, acts of state bodies, etc., which make it impossible to fulfill the obligations defined in these terms.

Article 6. Completeness of Terms and Conditions

The parties acknowledge that the General Terms and Conditions of Sale constitute the entire agreement between them.

Article 7. Copyright protection

All information on the website, including, but not limited to, the design of the website, videos, texts, graphics, logos, software are owned by the company or its partners as copyright, or have an appropriate license and other legal basis for their use. Such objects of intellectual property are protected in accordance with the procedure established by the legislation of the Republic of Armenia.

Any service provided by the company may not be reproduced, copied, sold or resold without the express written consent of the company.

Article 8. Dispute Resolution and Applicable Law

The Armenian version of the Terms and Conditions takes precedence over the versions in other languages.

The Terms may be updated at any time by posting on the Website. After installing the updated version, the Customer's continued use of the Site constitutes the Customer's agreement to the modified version of the Terms. Disputes arising in connection with these terms shall be resolved through negotiations.

In case of failure to reach an agreement, the disputes are subject to resolution in accordance with the procedure established by the legislation of the Republic of Armenia, in the courts of general jurisdiction of the Republic of Armenia. The order(s) registration, sales transaction data stored in the seller's computer systems will be considered evidence in case of disputes between the parties.
